POST JUDGMENT MODIFICATIONS

Even after a Judgment of Divorce or a Judgment of Paternity is entered, the court still has the ability (by retaining Jurisdiction) to make changes to an original Judgment.

These include changes to Child Support amounts, Child Physical Placement schedules, Child Custody, Dependency Exemptions, and Spousal Maintenance (alimony).

However, before modifications to a Judgment may be made, the party requesting the change has the burden of proving that a substantial or material change in circumstances has occurred, not just a mere change. Substantial or material change is such that it would be unjust or inequitable to strictly hold either party to the Judgment.

The courts can also address issues such as a request to move the minor child out of the state of Wisconsin, or to enforce collection of past due Child Support or Maintenance amounts (arrearages).

When someone disobeys a court order without justification, the other party may petition the court for a finding of Contempt, and request appropriate remedies to enforce the order.
