RESTRAINING ORDERS / INJUNCTIONS (Domestic Abuse and Harassment)
In situations where our clients are victims of domestic abuse or harassment, we assist them in obtaining Temporary Restraining Orders (TRO's) and/ or Injunctions. We also defend clients who have been unjustly accused of abuse or harassment.
- Domestic abuse - Defined in Section 813.12(1)(am) of the Wisconsin Statutes as an intentional infliction of, or threat to inflict physical pain, physical injury or illness, impairment of physical condition, damage to personal property, or sexual contact or sexual intercourse without consent. There must be facts showing an imminent danger of physical harm before a Temporary Restraining Order can be issued.
- Harassment - Defined in Section 947.013 as intentional harassing or intimidating another person by (a) Striking, shoving, kicking or otherwise subjecting the person to physical contact; or (b) Engaging in an act that would constitute abuse under 48.02(1); or (c) Sexually assaulting under 940.225; or (d) Stalking under 940.32; or attempting or threatening to do the same; or (e) Engaging in a course of conduct or repeatedly committing acts which harass or intimidate the person and which serve no legitimate purpose.
In either situation, Petitions/Motions for Temporary Restraining Orders or Injunctions can be filed, where the aggrieved party (the Petitioner) can request that the other party (the Respondent) be ordered to refrain from committing the specified acts; avoid contacting the Petitioner by any means, and be ordered not to possess a firearm.
- Temporary Restraining Orders (TRO's) - Generally limited to a period of 14 days. The Petition does not disclose the address of the alleged victim, and notice does not need to be given to the Respondent before the TRO is issued.
- Injunctions - Can be in effect for up to 2 years. They are issued by the Court only after a hearing is held on the merits of the Petition. Generally, the hearing must be held within 14 days of the filing of the Petition. The Respondent must be served with a copy or summary of the Petition, and with notice of the time and date for the hearing.
